Misdemeanor Theft in Texas

If you are accused of misdemeanor theft in Texas, the courts will classify your crime as an A, B, or C offense. These classifications are based on the amount of property that you allegedly stole, the way in which it was stolen, and the value of that property.

Here are the misdemeanor categories in detail:

  • Class C Misdemeanor: If you steal an item valued at $50 or less, you may be charged with this classification. Guilty parties can receive a fine up to $500 and do not serve jail time.
  • Class B Misdemeanor: Offenders can spend up to 180 days in jail and/or be forced to pay a fine up to $2,000 in this classification. The stolen property values in this category range from $50 to $500. Individuals are also charged with a Class B misdemeanor if they steal another person’s driver’s license or personal identification card.
  • Class A Misdemeanor: Penalties in this category can include 1 year in jail and $4,000 in fines. Defendants will be charged with a Class A if they stole property valuing more than $500 but less than $1,500.

Felony Theft Crimes in Texas

Theft cases involving more than $1,500 but less than $20,000 are considered a state jail felony and may result in up to 2 years in a state jail and fines of up to $10,000. Third-degree felonies warrant up to 10 years of confinement in the Texas Department of Criminal Justice, and second-degree felonies can result in 20 years. First-degree felony theft may result in up to 99 years in prison depending on the value of the property stolen. Some contributing factors to felony cases include the use of a weapon, aggravated assault, or stolen property of an extremely high value.
