Assault & Battery Cases in Texas

Assault and battery is considered a serious offense in Texas, and cases are punishable in various classifications. Whenever an individual intentionally or recklessly causes injury to another person, the victim can press charges. Assault also encompasses cases where one person physically threatens to harm another, even if they did not physically injure the victim.

Misdemeanor Assault Classifications & Penalties

Assault charges are divided into the following misdemeanor classifications according to the Texas Penal Code Section 22.01, et seq.:

  • Class C Misdemeanor: This classification includes unwelcome contact that is offensive or provocative. Threatening to harm another person is another offense in this category. Guilty parties may receive a fine up to $500.
  • Class B Misdemeanor: This crime includes injuring or attempting to injure a sports participant during a game or in relation to the game. Offenders can spend up to 180 days in jail for this crime and may need to pay a fine of up to $2,000.
  • Class A Misdemeanor: If you are charged with making offensive or sexually inappropriate contact with an elderly person, you will receive Class A penalties. This category also encompasses cases where one person causes bodily injury to another without any aggravating factors. Penalties include up to 1 year in jail and a fine not exceeding $4,000.

Penalties for Felony Assault

The Texas Penal Code outlines three degrees of felony assault:

  • Third Degree Felony: Offenses in this category can result in up to 10 years in jail and a $10,000 fine. Normally, they involve violent crimes against law enforcement, civil servants, or other government-related workers.
  • Second Degree Felony: Choking cases and domestic violence disputes are commonly prosecuted as second-degree felonies. Penalties include between 2 and 20 years in prison and fines of up to $10,000.
  • First Degree Felony: This classification is reserved for aggravated assault. Aggravated assault is a violent crime in which the defendant causes serious injury and/or uses a weapon. Some instances of first-degree felony aggravated assault can result in a life prison sentence. Guilty parties must serve at least five years.
