About DWI in Texas

When determining if you should be charged with driving while intoxicated, the police will measure your blood alcohol content (BAC) through a chemical test. This test will analyze your urine, breath, or blood, and will show how much alcohol is in your system. If it is at or above a certain percentage, you will face certain charges.

A first-offense conviction, if your BAC is less than 0.15%, includes:

  • A fine of up to $2,000
  • A driver’s license suspension of 90 days to 1 year
  • A jail sentence of 3 days to 180 days

This is a Class B misdemeanor. If your BAC is above 0.15%, or if this is not your first DWI offense, the penalties will be more severe.

Several other DWI conviction penalties in Texas include:

  • For a first-time DWI conviction with a BAC over 0.15%, you face a fine of up to $4,000 and a jail sentence of 1 year
