What Is a Traffic Ticket Warrant?

In most counties and cities in Texas, you are given approximately 21 days to contact the court about your ticket. If nothing is done on your ticket in 21 days, a traffic ticket warrant may be issued for your arrest.

Once a warrant is issued, you typically have four options, which are:

  • Doing jail time. If you choose to do jail time, it is considered a conviction, and you do not get to protect your driving record. Even though many people believe doing jail time is the cheapest option, it is now one of the most expensive options. Since 2003, Texas has been utilizing a surcharge program which requires Texas’s courts to report convicted offenders to the Department of Public Safety (DPS). This then leads to the state assessing exorbitant fines against individuals who may actually not be bad drivers. Therefore, doing jail time is not considered to be a good decision.
  • Paying off the warrant at the court window.. In doing so, you essentially are pleading guilty, and it is the equivalent of doing jail time in the eyes of the law. This option is also not recommended due to the many different penalties outweighing the benefits.
  • Posting a cash bond at court and requesting a court date. You are allowed to go to the courthouse and ask for a new court date. However, to do so, you will need to pay a fine. These fines are often extremely expensive and can be as costly as $700, depending on the case. If you are able to pay the cash bond, you will get a new court date, and you will be able to negotiate with prosecutors. Unfortunately, prosecutors are not always willing to negotiate, especially after you have paid more money for a new court date. Also, if you accidentally miss your new court date, you have essentially wasted however much money the cash bond cost you.
  • Hire an attorney to lift your warrant and protect your driving record. This option is highly recommended for numerous reasons. First, an attorney is typically significantly less expensive than a cash bond payment. Second, your lawyer will appear in court for you to resolve your traffic ticket warrants. In doing so, you may be able to keep your violations from being reported to DPS, thereby saving you significant money on fines and preventing your insurance rates from skyrocketing. Third, if the case against you is legally insufficient, a skilled attorney can work to get it dismissed. This would be the best-case scenario.
